Miami Beach Police have confirmed that toxicology report findings show that Karlie Tomica was, indeed, drunk when she allegedly struck and killed Terrazza executive chef Stefano Riccioletti on January 29.
MBPD Detective Vivian Hernandez confirmed the findings to Short Order. “Yes. She was three times above the legal limit.” Hernandez also said that Tomica will have to appear in court and face additional charges.
At first, Tomica was charged with leaving the scene of a crash involving death.
She will now likely be charged with a DUI and face harsher penalties.
Besides criminal charges, Tomica is facing several civil lawsuits. Jacopo Riccioletti, the eldest son of the chef, has filed a lawful death complaint against both Tomica and Penrod Brothers Inc. (DBA Nikki Beach Club).

Short Order obtained the the seven-page complaint which states
that Tomica was “under the influence of alcohol and/or her normal
faculties were otherwise impaired such that she could not drive safely.
Tomica was driving recklessly, not keeping a proper lookout and
violently struck the Plaintiff’s decedent while he was a pedestrian.”
It
furthermore states that Nikki Beach (The CLUB) “knew or should have
known that she (Tomica) was going to drive. It was foreseeable to the
CLUB that she posed a dangerous risk of injury or death to other
motorists and/or pedestrians.”
According to CBS Miami,
another lawsuit was filed by Patrizia Pesce, the ex-wife of Stefano
Riccioletti, on behalf of Riccioletti’s two minor children.
A
representative of Silva & Silva, the law firm handling the original
wrongful death complaint says that the attorneys for all parties are
working together and the lawsuits will likely be joined.
