Miami "Fashionista" Lawyer Sues Forever 21 Over a Penny
Carolyn Kellman, a local lawyer whose fashion sense caught the eye of the Miami Herald back in 2007, was doing some shopping at the Dolphin Mall and picked up some black denim shorts at the Forever 21. However, she decided to return them, and quickly realized that she was refunded a penny less than what she originally paid for them. So, obviously, she's now suing Forever 21 over that penny.
According to Law.com, Kellman bought the shorts at the Dolphin Mall Forever 21 for $14.46, and returned them a few weeks later at the Sunset Shops Forever 21 for $14.45. In June, she bought a black skirt at the Sunset store for $11.57 and then returned it at the same store and only received $11.56.
Kellman has now filed suit and contends that Forever 21 runs a penny-skimming scheme. Kellman is employed with Strickland Law Firm in Coral Gables, but has hired Kevin Love of Criden & Love in South Miami to handle the suit.
"It might not be a lot of money, but nonetheless it's a violation," Love told Law.com.
The lawsuit has been filed as a class-action suit, meaning the suit has been filed on behalf of anyone who has been charged a penny more or refunded a penny less by the retailer in the past five years. Though, because the class-action suit was filed in Miami-Dade, the total money of the rip-off must be worth more than $15,000. That translates to 1.5 million pennies, or, as Law.com puts it, "at least 750,000 customers making and returning purchases since 2007."
This should be a legal change of pace for the cheapo retailer. They get sued pretty regularly, but usually for ripping off the designs of legitimate designers.
