Student Who Was Statutorily Raped by Teacher Sues Miami-Dade Schools

A former student who lost her virginity to her teacher in a classroom is now suing Miami-Dade County Public Schools for failing to properly protect her. The now-17-year-old victim says the teacher, 33-year-old Bresnniell Jansen, had previously been accused of sending an inappropriate text to another teen in 2008 but was never disciplined.

"On December 20th of 2013, Bresnniel Jansen took the virginity of one of his students on his desk inside a classroom at South Dade High School. This followed months of inappropriate communication, sexting, touching, digital and oral sex," attorney John Leighton told CBS 4.

Jansen was a geometry teacher at South Dade Senior High in Homestead. He was arrested on school grounds January 9 and pleaded guilty to unlawful sexual activity with a minor in September. He now no longer works at the school and is a registered sex offender.

But the victim and her family claim the situation should have never happened. Jansen was investigated in 2008 for allegedly sending an inappropriate text to another student, but the district didn't find enough evidence to punish him.

Attorney Leighton even criticized Jansen's choice of work outfits.

"He wore shirts that showed his muscles to class and tried to impress these young students that he was good looking," Leighton said. "To let a teacher back in a classroom without any kind of supervision after there has already been a suggestion, an accusation of inappropriate contact with a young female, a young student, this is outrageous."

The victim was allowed to transfer to another school, but no one took into account the fact that Jansen lived closer to her new school. She claims she saw him near his home her first day at the new school and was too distraught to attend classes there. She completed high school through home schooling. She also says she attends weekly therapy sessions and one day hopes to become a psychologist herself.

The victim and her family now plan to file suit against the school for unspecified damages.
