Commissioner Marc Sarnoff cited for violating city code

Is it payback for rolling back last call in Coconut Grove?

Call 305-441-5966 and you will reach Miami Commissioner Marc Sarnoff's private law office, located at 3000 Shipping Ave., a two-story residence right next door to the property he calls home. Since before he was elected commissioner in 2006, Sarnoff has remained steadfast that his business address is absolutely legal and that he can practice law from there. During a phone conversation with Riptide August 27, the Coconut Grove politician reiterated he has obtained all the proper permits and that he has a certificate of occupancy for his firm, Sarnoff & Bayer. "I am not operating an illegal office," Sarnoff insisted.

Yet a day before the commish spoke with us, Miami's code enforcement office sent Sarnoff a violation notice informing him that he had failed "to follow the requirements for a home occupation business." The city's crackdown happened after three of the commissioners' most vociferous critics pressured code enforcers and city attorney Julie Bru to cite Sarnoff. It began with an email August 4 to several city officials and local news reporters (including this staff writer) from John El-Masry, owner of Mr. Moe's Restaurant and Bar, who is suing the commissioner and the city in Miami-Dade Circuit Court. El-Masry claims he has lost business ever since Sarnoff championed the rollback of last call at Coconut Grove bars and clubs from 5 a.m. to 3.

In his electronic missive, Mr. Moe's proprietor laid out several reasons Sarnoff is operating an illegal office, such as not having a valid certificate of occupancy, and that city code prohibits professional associations such as Sarnoff & Bayer from operating out of a single-family home.

When the city's code enforcement office ignored El-Masry's complaint for almost three weeks, Coconut Grove Village Council member Stephen Murray and local blogger Al Crespo sent letters August 25 to Bru accusing her and code enforcement officers of stalling. "It appears to me that Mr. Sarnoff has been receiving special and preferential treatment because of his status as an elected official," Murray wrote. Crespo wrote that "the stench associated with... the abuse of power and the glaring examples of special treatment in this matter are stunning."

Sarnoff told Riptide that Murray and Crespo are working with El-Masry to smear him: "John is angry. This is one of the ways he is trying to get back at me." Still, asked to provide proof to us that his law office is legal, the commissioner claimed he doesn't have the documentation. "The city has it," he said. "Although they are having trouble retrieving the files."

El-Masry doesn't hide his contempt for Sarnoff: "The guy is a liar and a hypocrite. My goal is to expose him." Said Murray: "People need to know who the real Marc Sarnoff is. They need to see the guy behind the curtain."

Sarnoff has until September 7 to correct the violation.

    Five years ago Marc Sarnoff dated my brother Kevin and they purchased a house together with a promise that he ( Marc Sarnoff ) will pay 50% of the 20,000 deposit. To this date he has not given my brothewr one cent and when they broke up it hurt my brother financially. Marc is nothing buy a gay tramp that secretly jumps from one gay relationship to another. His little gay secret life should be exposed

    I think that if Mr. Sarnoff does have the appropriate documentation, he should not waste taxpayers's money by stating "the city has it" and have them go crazy looking for something that might not be there. Typical attorney talk. Well, it would look much better for you as a politician and a practicing attorney, to cough up the proof and have all the others eat their words! The only reason you might be stalling is that in fact, they are correct and you can't proof you're legal. So, you are using the city's own disarray (of which you are well aware of, to get your cuase. Shame on you, what will this do to your integrity?

    With all the problems we're facing in this state and Country, THIS is what we have to read about? No wonder qualified, intelligent people like Sarnoff hesitate to run for politics today, it's become a joke when people like Crespo and El-Masry, ex-con's and men of questionable character, can influence the City Attorney over something so meaningless. Sad.

    I can't believe the City Attorney wasted her time with this. What a joke. El-Masry is a cry baby, and I'm glad his club can't be open past 3 am, only losers and drunks are out past that hour, and I'm glad they're off the streets.

    Those of us who know Mr. El Masry know how ridiculous this "citation" is and for him to call Sarnoff "a hypocrite and a liar" is like the pot calling the kettle black. PLEASE. It's nothing more than his attempt to get back at the Commissioner. I'm disappointed the City fell for it.

    This story is ludicrous. Everyone knows El-Masry has an agenda and Al Crespo is a joke. He's a synical, angry ex-con who spends his life attacking others all the while he's got a criminal record...what a hypocrite. How about doing something worthwhile for our community to show you've "changed". Now he and Masry have focused their negative energies on Mr. Sarnoff, which is a complete waste. We need our politicians spending their time and energy figuring out how to get City out of the mess we're in...not wasting time having to deal with B.S. like this. Come on, does anyone notice we're in a crisis here?

    There is absolutely nothing that can happen after 3:00am that can't/wont happen at 1:00am or 2:00am or 2:59am. Thats an absurd law. Either ban alcohol consumption totally or let it be sold at any time. Putting hourly restraints makes absolutely no sense. It has nothing to do with safety, it has everything to do with Marc Sarnoff not wanting people in his neighborhood partying so they came up with 3:00AM. Why because if he wouldv'e said Midnight every business would have surely been closed by now.

    What I like best about this article is: It shows the readers El-Masry is a bad person. Nothing good happens after 3:00 AM El-Masry. Be happy you were stopped.
