FBI tries to deport Muslim man for refusing to be an informant

After Imam Foad Farahi declined to become a federal informant, the government tried to destroy him.

It was November 1, 2004, the day before George W. Bush would win a second term in office. But the Muslim holy man had been too busy fasting and praying to pay much attention to the presidential election.

For Farahi, an Iranian citizen who had lived in the United States for more than a decade, it was simply another month of Ramadan in South Florida. Then, around 5 p.m., as he neared his apartment, he saw two men standing outside. They were waiting for him.

"We're from the FBI," one of the men said.

"OK," he responded.

They wanted to know about José Padilla and Adnan El Shukrijumah, two South Florida men linked to the Al-Qaeda terrorist network. Padilla, the so-called Dirty Bomber, was arrested in May 2002 and initially given enemy combatant status. He eventually stood trial in Miami, was convicted on terrorism charges, and sentenced to 17 years in prison. Shukrijumah is a Saudi Arabian and an alleged Al-Qaeda member whose last known address was in Miramar. The FBI is offering up to $5 million for information leading directly to his capture.

"I know José Padilla, but I don't know Adnan," Farahi told the agents.

Of course, Farahi knew of Shukrijumah. As imam of the Shamsuddin Islamic Center in North Miami Beach, Farahi was in a unique position to know about local Muslims, including Padilla and Shukrijumah. Padilla had prayed at Farahi's mosque and was once among his Arabic students. Shukrijumah was the son of a local Islamic religious leader.

"I have had no contact with Padilla since 1998, when he left the country," Farahi told the government agents. He had once met Shukrijumah but had no contact with him after that. "I don't know anything about his activities."

"We want you to work with us," Farahi remembers the agents telling him.

And this is when the imam's five-year battle with the federal government began.

"I have no problem working with you guys or helping you out," Farahi said. He could keep them informed about the local Muslim community or translate Arabic. But the relationship, he insisted, would need to be public; others would have to know he was helping the government.

But that wasn't what the FBI had in mind, Farahi says. The agents wanted him to become a secret informant who would investigate specific people. And they knew Farahi was in a vulnerable position. His student visa had expired, and he had asked the government for a renewal. He had also applied for political asylum, hoping one of those legal tracks would offer a way for him to stay in the United States indefinitely.

"We'll give you residency," the agents promised. "We'll give you money to go to school."

Farahi considered the offer for a moment and then shook his head.

"I can't," he told them.

The slender, bearded 34-year-old Farahi frowns as he recalls all of this while sitting on a white folding chair in the Shamsuddin Islamic Center on a recent afternoon. "People trust you as a religious figure, and you're trying to kind of deceive them," he says, remembering the choice he faced. "That's where the problem is."

Farahi soon discovered the FBI's offer wasn't optional. The federal government used strong-arm tactics — including trying to have him deported and falsely claiming it had information linking him to terrorism — in an effort to force him to become an informant, he says.

The imam has resisted the government at every step, having most recently taken his political asylum case to the U.S. Court of Appeals in Atlanta.

"As long as you're not a citizen, there are lots of things [the government] can do," says Ira Kurzban, Farahi's attorney. "They can allege you're a terrorist and try to bring terrorist charges against you, or they can get you deported." Terrorism, he explains, can even be defined as giving "money to a hospital in the West Bank that turns out to be run by Hamas."

Farahi asserts unequivocally he is innocent of any terrorism charges the government could bring against him. In fact, he says, he would report anyone in the Muslim community supporting terrorism. "From the Islamic perspective, it's your duty to respect the law, and if there's anything going on, any crime about to be committed, or any kind of harm to be caused to people or property, it should be reported to the police," he says.

The FBI's intense efforts to pressure Farahi into becoming an informant reveal the bureau's desperation to infiltrate local Muslim communities. The hard-line tactics have become so widespread in the United States that the San Francisco-based civil rights group Muslim Advocates distributes a video advising how to respond if FBI agents approach.

In fact, relations between the FBI and U.S. Islamic communities are so strained that a coalition of Muslim-American groups in March accused the government of using "McCarthy-era tactics" and threatened to sever communication with the FBI unless it "reassessed its use of agent provocateurs in Muslim communities."

    Since he is a foriegner that has knowlegde and relationships with Muslim Terrorist he should earn his legal status and they great benefits that we pay for that comes with legal resident status and share infromation with whatever US organization that comes asking that includes going out of his way. Earn that right towel head. He was not born with that priviledge yet he wants it for free. No free lunch pal. Flip on those damn Muslim Terrorist!

    The FBI asked him to give them info on people that maybe conspiring against the US. He did not cooperate. He would let people know what he was doing. I don't think a terrorist is going to confide in him if he tells him he'll pass on the info to the FBI. You can't straddle the fence. He's not compromising anyone that doesn't have bad intentions. He is in a psotion that could potentially save lives and he refuses to help. It's a privilage that he is allowed to stay in the US not a right. Let him straddle the fence back in Iran.

    Read the article. He did cooperate with them, and answered all their questions. What he refused to do, was to actively spy on people. He is in a position of trust and it is not fair to force someone to abuse their trust. All these terrorist plots that have been "thwarted" were concocted by the FBI and then they recruit people, arrest them, and say they stopped a plot... which they came up with. I am appalled by how sick and racist many of you are. These privacy invasions are exactly why the US revolted from England. I am not afraid of being killed by a Muslim "terrorist." I am afraid of my daughter being raped and murdered by Christians in this country. A few years ago, I was granted a rare opportunity for a Westerner to visit Mecca. In that city, when a jewelery store owner, with gold chains out in the open, closes for lunch, he simply puts a rope across the door that signals he is closed. Because in the city that is only Muslim, he knows his stuff will be safe. Those are the people you are terrified of? Compare that to the church goers who kill gay people because they are immoral. Who should you be afraid of? Personally I am thrilled that a person like this is in our country. I bet he has a more positive influence on this country than the rest of you trolls. Remember the Anthrax attacks of 2001? All you racist scum were out there harassing your Muslim neighbors while a CHRISTIAN was sending anthrax out to senators. Forgot about that?     There is no right for this Iranian citizen to live in the US. We are at war and there is an expectation that people who wish to live in the US and enjoy the freedoms offered here cooperate in protecting the country from Muslim terrorists. If that's too much to ask then the Imam needs to leave he can go to Kuwait if he does not wish to return to his Iranian homeland. Living in the US should no longer be an option.

    Ira Kurzban is an exceptional individual. Without men like him 'allowed' to practice law, US jurisprudence and the constitution itself would be just as big of a sham as that of the Soviet Union, Cuba, Venezuela, or any other bananna republic. Kurzban is truely one-in-a-million (unfortunately). If Ira was only interested in making a buck, the government would have to hire someone to do the kind of work he does -and the world would be justified in calling the American justice system a sham. [Of course politicos love manipulating him as a cost free & "politically independent" vehicle for various political agendas & free media air time -which is why they allow him to exist].

    This is yet another tragic example of how this country made the decision many years ago to forego the collection of real intelligence and instead use racial profiling, torture, and fear tactics to wage its war on terror. The US is this man's country just as much as it is anyone else's - let him stay! And reform the corrupt and backwards immigration system and block the holes through which asylum seekers like this are sent to persecution. Ronald Reagan (ironically) said it best - America is (and should be) a beacon of freedom in the world for refugees.

    Big Hern, I think you're mistaking Muslims for Evangelical Christians and Zionist Jews. They're the ones who want to blow the world up in order to hasten the return of the messiah (sp) not the Muslims. And what's scarier is they have the means and motivation to. At the end of the day, it has yet to be proved, ever, that a Muslim has known about an impending plot (going all the way back to 9-11) and not come forward about it. So, for starters, this makes the FBI out to be ghestapo like storm troopers. Second, some of these spectacular attacks that have been thwarted by the FBI came in the form of entrappment. Third, it would be better for the FBI to develop relationships with Muslim-American leaders like Hamza Yousef and Zayd Shaker, who are natural born American Muslim converts and scholars, and make an effort at genuine outreach to the community then provide community members with the ability to come forward (privately or not) with information that can help secure our homeland (last i checked terrorists didn't ask for ID cards before blowing themselves up among innocents). Recruiting the Muslim-American community in this manner buidl trust and patriotism and makes everyone safer.

    US law implementing the Treaty on the Protection of Refugees gives broad national security discretion to the President. The 'non-refoulmont' provisions prevent forced return to a nation where the asylum seeker "would" be [killed]. Many, therefore, end up detained indefinitely due to provisions regarding placement in designated third countries that have never been hammered out between the US and proposed third country(s)(-not to mention failure to implement/enforce other enacted provisions of US asylum law such as review of approved asylum cases after one year for continued basis of claim). Canada has always been a defacto "third bite at the apple." The question remains: "Does one fear the cold more than one fears "certain" death?" G'd bless America!

    A religious congregation is almost always open to the public. There are no tests for admission to attend services, especially not on major holy days, when almost all faiths see an influx of people who are new, or returnees, or infrequent attenders. Most congregations encourage such people, reach out to them and seek to involve them in more regular practice of their faith. The only test for presence should be interest in the religious activity, and willingness to respect norms of behavior appropriate to the service. Let's imagine instead of Foad Farahi a Baptist pastor. Someone came to Easter services a few years ago and later became involved with the Nazi party. Do you prosecute the pastor? I hope not! Nor do you try to subvert him and undermine his position in his faith community, because if he's a decent pastor he's the best protection possible against people turning to violence. Foad Farahi sounds like a thoroughly decent person and a good clergyman. The government should leave him alone. The FBIs activities, as recounted here, are appalling.

    I know Imam Fadi personally. He is in no way involved in any terrorist activity. The FBI has harassed plenty of my friends claiming of terrorist information (citizen and non-citizen). Their tactics are illegal and wrong!!! It won't be long until I'll be investigated....
