Free Lionel Tate

New evidence in the notorious bad boy's latest crime

For the past two years, two months, and ten days, out on the western fringes of Miami-Dade County, Lionel Tate has been sitting inside a prison cell at the Everglades Correctional Institute for a crime he almost certainly didn't commit.

In fact two South Florida private investigators allege DNA evidence — as well as two new victim statements — prove Tate likely didn't rob, at gunpoint, Domino's Pizza delivery man Walter Gallardo inside a Pembroke Park apartment May 23, 2005.

"The Broward State Attorney's Office knows they got the wrong guy, but they are not going to do anything about it," hisses 51-year-old Miami private eye Joe Carrillo. "And it stinks."

Carrillo is a tall, boisterous man whose sleuthing skills helped Miami Police Department nab the Shenandoah Rapist, Reynaldo Rapalo, in 2004. He and former FBI agent Bob Whiting have been working without pay on Tate's case for almost two years.

You might remember Tate. He was 12 years old back in 1999 when he was accused of battering to death six-year-old playmate Tiffany Eunick. Two years later, Tate was tried and convicted of Eunick's first-degree murder. His trial lawyers unsuccessfully argued that Tate had been imitating wrestling moves and that the girl's death was an accident.

Two years after Eunick's death, Tate became the youngest person in U.S. history to receive a life sentence without parole. But an appeals court reversed the conviction in 2003, and he was freed a year later. He avoided a retrial by pleading guilty to second-degree murder in exchange for one year's house arrest followed by ten years' probation.

Then in September 2004 police found him a few blocks from his house at 2:00 a.m. carrying an eight-inch knife. Broward Circuit Court Judge Joel Lazarus tacked another five years onto Tate's probation.

Nine months later, Tate was busted for the pizza stickup. And because of his past problems, this one really could put him away for life.

Here's what happened, according to Tate's arrest report. Gallardo was delivering the pies about 4:20 p.m. to unit 208 at 3871 SW 52nd Ave. in Pembroke Park (just north of the Miami-Dade County line in Broward). Initially there was no answer at the second-floor apartment, so Gallardo turned around to leave.

Then the delivery man heard someone yell "Hey!" while he was descending the stairs. He walked back up, saw unit 208's door slightly ajar, and walked in. Behind the door, Gallardo told BSO detectives, was a black man with a black bandanna covering his mouth and pointing an "old handgun" at him. Later that evening, Gallardo identified Tate.

Since then Tate has been incarcerated without bond and has cycled through three defense lawyers, including the late Ellis Rubin.

At first it seemed the evidence against Tate — who's now 20 years old — was strong. He admitted calling Domino's to order the pizzas. And when police searched the apartment of a onetime neighborhood chum, Willie Corouthers, they found a pair of maroon shorts Gallardo claimed the assailant wore; they contained traces of Tate's DNA. He even accepted a plea deal but then changed his mind.

Indeed the two private eyes have uncovered evidence that should lead cops to further probe the role of Corouthers, who was 16 years old at the time of the pizza caper and lived on the first floor of the building where the crime took place. Despite several calls to a cell phone listed in public records and three visits to his last known address in Miramar, New Times could not reach Corouthers for comment.

An aspiring rapper who goes by the handle "Little Will," Corouthers met Tate through mutual friends sometime in late 2004, according to a sworn statement Corouthers gave prosecutors in September 2005. "Some days I would see him walking to school," Corouthers said. "But I never said anything to him until he started coming around where I live."

On the day of the robbery, Tate sent Corouthers a text message: "U still want to bust that lick after school?" In the statement, Corouthers explained that "bust that lick" is slang for robbery and that Tate was referring to stealing from an unidentified Hollywood teenager who carried around a lot of money. But it never happened. "That was all talk," Corouthers added.

Corouthers claimed he was on the sidewalk outside the apartment building when Gallardo drove up. "Lionel was at the top of the staircase," Corouthers told the attorneys. "He said, 'I ordered the pizza, sir.' Lionel goes into the house, and the pizza man is like right behind him." A couple of seconds later, Corouthers said, he heard Gallardo scream and saw Lionel waving a gun at the man. "The man falls, boom, and then either he fell down the stairs or he ran," Corouthers said. "He's screaming help, help, help."

That doesn't jibe with Gallardo's account. The pizza man said he didn't see anyone before knocking on unit 208. And Corouthers, whose fingerprints were found on one of the pizza boxes, didn't mention the black bandanna, which should have been obvious.

Enter Tuquincy Thompkins, who was 12 years old and lived in the apartment where the robbery took place. Initially Thompkins told BSO detectives he saw Tate rob Gallardo. Two months after the robbery, though, Thompkins recanted his story to private eye Carrillo.

    This is the monster that killed my friend Tiffany Eunick. I was 5 years old at the time and, she frequently in my grandmothers care until the day we had moved. Her moth decided to let one of her friend babysit her which lead to this. Tiffany may had been older than me and sometimes we played raff but she always knew when to stop. I mind you, SHE WAS 6 YEARS OLD. Now, I am 16, and I have and will NEVER play with anyone to such a horrible degree let alone a GIRL. He knew what he was doing, and he saw she was in pain. It wasnt innocent child play. If it was she would be here today but instead he murdered her. He deserves death, and if the justice system doesn't give it to him I hope one day someone will. Just as butall was the way he killed her.

    Clearly the District Attorney is more concerned with his conviction rate than freeing an innocent man. Guilty until the D.A decides what is in his best interest. I have seen cases overturned for less than this. He COMMITTED A CRIME BEFORE, therefore he must be guilty. As for the first incident with the little girl, what was so important that the Mother had to leave a 12 year old boy with a 6 year old alone to play upstairs out of her sight.? No way in the heck would I leave my 6 year old daughter with a 12 year old boy or girl under any circumstances alone in my house!!

    My heart goes out for Tiffany and her family as well as Lionels. I can't imagine a 12 year old intending to kill someone in this manner and be in his right state of mind. If so, he obviously has a mental disorder of some kind. I believe his parents failed him in more ways than one. I do not believe the father was involved in his life and mom was a busy, single, working trooper. Seems as though Lionel had to fend for himself quite a bit. I am not condoning his actions, they are horrific, but I do question his mental state/emotional development, he did have the capacity to alert his mom the lil girl was not breathing, it shows some sence of caring. I do feel he should not have been thrown to the wolves at such an early age into an adult facility, that is down right unimaginable, and likely had something to his poor readjustment back into society. It's a difficult case to swallow involving two children whom were failed in one way or the other. I do hope Lionel can rehabilitate himself and possibly tell his story to allow others some insight into his life. Some of you are just plain evil, so sad that you bash this guy but from your comments you are very much capable of doing worse things than he did.

Didn't he break the rules of his house-arrest some time earlier...oh and didn't he kill a 6 year old girl when he was an oh-so-appropriate age? Yeaaaahhhh...I say let him rot. Or sizzle.     I grew up with lionel when I was about 11-12 years old. I lived in hallendale, florida. I forget the name of the apartments we lived in but it ended with "Wood" anyways. I used to always buy pickles and popsicles off of him while his mother was at work, I even met his little cousin one time, I believe I used to hang out with either his little sister or his little cousin... He always seemed alittle "off" in his mind, like... he was kinda slow. I didn't think nothing of it at that time because I was so young I was not the type of child to judge someone due to their processing skills. I was in the swimming pool one time with Lionel, while my mother sun bathed on a tanning chair by the shallow end of the pool. Lionel was fake wrestling with me, it was nothing serious at first, but as he flipped me and pushed me under the water, he grabbed me by my waist while I was upside down submerged, and slammed my head into the bottom of the pool floor. She told me I was not allowed to hang out with him anymore. So I never did again.     Nisha, check your head. He wasn't an angel when he went in to prison, and nobody doing time for murder, much less other serious crimes, comes out of the system an angel. As has been stated, by age 12, the difference between right and wrong is well known if you aren't defective. Also, it's incredible to see the twisted groupies come out of the woodwork for killers.

    I've been following this story from day one and was very angry when the MOTHER did not stand up for her child. The courts failed Lionel and you heartless people are continuing to fail him. When you put a child in jail with GROWN MEN, what did YOU think was going to happen to Lionel? He was not going to come out some angel of course. Not only this did any of you read the story? Lionel did not rob the pizza man! The pizza man didn�t even know who robbed him. He couldn�t see his face and simply pointed out A BLACK MAN! But his MOTHER failed him more. WHERE WAS THE MOTHER WHEN ALL OF THIS WAS GOING ON?!!! You were the babysitter not your son! The judge and you people that were on here expressing your thoughts and careless feelings about this subject should be ashamed of yourself! Lionel's sorry mother was the blame for taking on the responsibility of someone else�s CHILD! Lionel my heart goes out to you because you were only a CHILD when this happened. You had no business going to jail with grown MEN for a simple mistake you made.     I wouldn't show sympathy for that dishonest selfish arrogant son of a bitch like the judge told his lawyer "IN PLAIN ENGLISH YOU'VE RUN OUT OF CHANCES YOU DON'T GET ANYMORE" well he was right lionel done ran out of chances because he blew them all and he never should have been let out of prison in the first place after what he did to that innocent 6 year little girl because of all the rough housing and horseplaying he caused that lead to that murder, that bastard should stay in there and pay for what he had done and pay the price for the disdaine and trouble that he's been getting from the crowd he's been hanging around with I mean his mother should have told him what the consequences were but it was too late for that now he's right back where he belongs!

    He is not an animal...as kids we wrestled like this all the time. Hell i even power bombed my nephew a couple of times and he is perfectly fine. You guys obviously see that it is a black young man and he is deemed a thug/menace to society. Even your comments to Theresa are racially biased because she is not on your side?     Thanks Theresa for all your comments. Thank God there still are people like yourself who can think the way you do. If we have so much criminality in this world, it's because of people like the other commentators who obviously know nothing about the case itself, and are judgmental to feel better about themselves and their own "uglyness"!! What's happening to lionel is not his mom's fault and she's acting like any mother would for their child (stand behind and stand firm no matter what). I would do the same for my kids and shame on you if you wouldn't. I am christian and since 1999, I've been praying for Lio and one day, a song came to me about him...a song to God, a prayer to God to remember Lio because he was forgotten by all of us, the justice system, society itself but not from God. And I know that all the prayers that have gone on his behalf will be answered and Theresa, don't give up the good work...one day you will see the fruits of your work...As for me, I'll follow up on Lio's case and I know that Lio will be remembered!!

    Sorry to disappoint "Martha" and "Vincent",but no, I am not even remotely brain dead nor am I Kay. What I am is intimately acquainted with the case and evidence that you do not know about and have not seen. As tragic as Tiffany's death was, I must clear up something here. 35 injuries, you say. She obviously was not that "beaten up" if the EMTs responding to the scene thought initially that she had choked on food because there were no injuries apparent. Do you know where the liver is located on the body? Right where someone (A rather large 6'4, 200+ lb. someone) who is performing CPR could shred and detach it with minimal effort. I SINCERELY hope that this is not a sample of what can be expected in the way of a jury pool. By the way, I am a native Californian, not much chance of being a SOUTHERN backwoods hillbilly who frequents the use of extremely vulgar and offensive language.

    I think there has to be better causes to get behind than "Free Lionel Tate"? This kid is nothing but trouble and justice has finally happened and he will be thrown in jail where he belongs! I agree that the life sentence he received at 12 was too harsh. However, he should've done some adult jailtime for killing that little girl. He obviously learned nothing and the way his mother raised him had something to do with how messed up he is. Tate is in jail where he should've been all along and how let's start another cause "Keep Lionel Tate in jail"!

    Vincent - I thought the same thing when I read Theresa's comments. I suspect Theresa may be Lionel's mommy incognito! I cannot for the life of me see why so many on here feel sympathy for this thug. He obviously learned nothing from the death of Tiffany or from being incarcerated as he keeps on committing crimes.

I guess he still thinks he can get away with everything since he has gotten in trouble twice since being let out, the first time a mere 1 1/2 years after being released. Any of you that feel so much sympathy for this animal should keep in mind the innocent, six year old child he viciously murdered. Tiffany sustained 35!!!! injuries to her little body. This was no accident - it was a brutal, deliberate, vicious beating. He and his pathetic mother should be thrown in jail with no pissiblity of parole. She is just as guilty as him since his entie life she has excused everything he did and taught him nothing is his fault. It has been documented that he bullied other children in school repeatedly and mommy would show up in her state tropper uniform complete with the gun on her hip to confront teachers if they had complained of his aggressive behavior. It was never her Lionel, it was always the other child. Why all the sympathy for this animal? I feel sympathy for Tiffany and her mother, the real victims in this. Lionel is not a victim, he is a victimizer and always will be. How many more crimes does he need to commit and how many more people does he need to murder before you bleeding hearts stops defending this animal?

    Is Theresa Johnson brain dead? Wake up!!! The MONSTER, Lionel Tate KILLED a beautiful young girl, his life was over at that time. By chance, are you related to the MONSTER Tate? I posted earlier but seriously when I read comments that the "boy" was unjustly treated, it makes me want to puke! At 12 years old, most "normal" kids know the difference from right and wrong. If by chance he is mentally challenged, then institutionalize the "MONSTER" As for Theresa Johnson calling anyone "backwoods" is like the pot calling the kettle black.

    It's no small wonder murder, robbery, and assaults are on the increase when you have a 12 year old committing murder and being freed by a weak judicial system and public pressure. Why have any laws? Lionel Tate's mother should be held accountable as well as the father. Lionel is troubled alright, and obviously has not learned from the tragic death of the young girl as he is continually associated with one crime or another. Let's save everyone the future grief and lock him up for good. The original verdict should not have been overturned in the first place. I am in the visible minority as well and I am sick of the black people committing an exorbitant amount of crime and crying discrimination when it comes time to pay the Piper. You do the crime, you do the time.

    When I saw the 12-year-old Tate interviewed on 60 Minutes by (I believe it was) Mike Wallace, it was clear that this little piece of work was going to be trouble for other people for his entire life. My feeling was they should have executed the little n., just to make sure that the sort of annoyance he has continued to occasion could be avoided. Sometimes you just see and hear someone, even a child, and realize that the world is going to be better off without him. Lionel Tate is just such a one.

    This article sheds some extremely important light on Lionel's case. It is absolutely true that he did not do what he is charged with. They have charged him with armed robbery with a gun(false, Willie DID it), and with breaking and entering a structure(Taquincy's house, again Willie did it). Willie's gun, his grandmother keeps it hidden for him, was the gun used in the robbery, and the State Attorney's office KNOWS this, and so much more.My guess is that they believe that they can get away with this Mike Nifong style prosecution, after all, hasen't the regular media been on their job and poisoned S. Florida to believe BSO's false and contrived version of what occurred that day? I have tried for TWO years to tell this story to the Miami Herald, the Sun-Sentinel, and even the New York Times- all to no avail. Thank you for running this story, it needs to be told. What is happening to Lionel is criminal in itself, shame on those involved in ruining this young man's life.

    I do agree with Jean that the parents should share some blame for not instilling a conscience into young Lionel. Even if he's not the one who pulled the gun on the pizza delivery guy, look at the crowd he's hanging out with... It should be obvious that people in the early stages as that of Lionel do not recover & learn respect for life, not only for themselves, but for others. Look @ the kid who opened fire @ the Virginia Tech campus, he was troubled too. Look @ Columbine... It's a darn shame, but kids like these don't experience spiritual awakenings... they are already lost to society from the moment that their parents do not plant the seed of respect, love & compasion. I'm sorry, but the only future that people in Lionel's shoes have is to be locked away from the rest of society before any more innocent people are harmed or killed from the mistakes of the lenient judicial system.

    Lionel Tate should NEVER have been sent to jail as a child! His MOTHER should have gone to jail for not supervising the children! SHE is the problem and SHE is the one who has ruined her son's life! This is only the latest event in his life and I am willing to bet there will be more. This boy has NOT had any parents or guidance! When he was first in the news my heart ached for him and his troubles. Poor little boy that he was - no parents to teach and take care of him.
